01Acceptance of terms

By creating an account, accessing, or using BricksDeck, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy policy. If you're using the platform on behalf of an agency, you represent and warrant that you have the authority to bind it to these Terms. If you do not agree, you must not access or use the platform.

02Description of service

BricksDeck is a B2B Software-as-a-Service (SaaS) platform built for real estate agencies in India. The platform provides:

• —a CRM for inventory, leads, deals, and team management;
• —lead aggregation from listing portals into a single inbox;
• —the BricksDeck — a magazine-quality property document, generated on demand;
• —an AI sales agent that qualifies and replies to buyers on WhatsApp;
• —voice-note capture, transcription, and follow-up scheduling;
• —role-based access and team collaboration.

We reserve the right to modify, update, or discontinue any feature of the platform at any time, with reasonable notice to active subscribers.

03Account registration and responsibilities

To use BricksDeck, you must:

• —register for an account with accurate and complete information;
• —keep your login credentials secure and not share them with unauthorised individuals;
• —promptly notify us of any unauthorised access to or use of your account;
• —ensure everyone you add to your agency's account complies with these Terms.

You are responsible for all activity that occurs under your account. We are not liable for any loss or damage arising from your failure to safeguard your credentials.

04Subscription and payment

Our paid plans are governed by the following terms:

• —Plans — features, pricing, and limits are published on our website and may be updated from time to time.
• —Billing cycle — subscriptions are billed monthly or annually, as selected at sign-up. All fees are quoted in INR and are exclusive of GST.
• —Payment — fees are due at the start of each billing cycle, via UPI, net banking, or credit/debit card.
• —WhatsApp costs — the per-conversation charges Meta levies are passed through to your invoice at cost.
• —Late payment — if a payment is more than 7 days overdue, we may suspend access until it is settled.
• —Refunds — subscription fees are non-refundable, except where required by law or at our sole discretion.
• —Price changes — we give at least 30 days' notice before any price increase takes effect for existing subscribers.

05Acceptable use

You agree not to use BricksDeck to:

• —violate any applicable local, national, or international law or regulation;
• —send spam or run marketing your recipients haven't agreed to;
• —harass, mislead, or defraud buyers;
• —upload, store, or transmit content that is unlawful or that you don't have the rights to;
• —attempt to gain unauthorised access to other accounts or our infrastructure;
• —reverse-engineer, decompile, or disassemble any part of the platform;
• —use bots or scrapers to extract data without written permission;
• —breach Meta's WhatsApp Business policies;
• —resell, sublicence, or redistribute access to the platform without our written consent.

Violation of this policy may result in immediate suspension or termination of your account.

06Intellectual property

The BricksDeck platform — including its source code, design, interface, documentation, branding, and logos — is owned exclusively by BricksDeck and protected under applicable Indian and international intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable, revocable licence to use the platform solely for your agency's internal business during the subscription term. This licence conveys no ownership rights.

07Your content

You retain full ownership of everything you upload, create, or generate on the platform — your inventory, photos, copy, buyer data, and conversations ("Your Content"). We claim no ownership over it. You grant us a limited licence to process, store, and display Your Content solely to provide and improve the service, and we access it only as needed to run the service, support you, or comply with the law. After termination you may export Your Content for up to 60 days, after which we delete it in line with our Data deletion policy.

08Service availability

We strive to keep BricksDeck highly available, with a target uptime of 99.5% measured monthly, excluding scheduled maintenance windows.

• —Scheduled maintenance — we give at least 24 hours' notice for planned work, typically during off-peak hours (IST).
• —Unplanned downtime — we make commercially reasonable efforts to restore service promptly and keep you updated.
• —No guarantee — the platform is provided on an "as is" and "as available" basis; we don't warrant it will be uninterrupted or error-free.

09Limitation of liability

To the maximum extent permitted by applicable law:

• —BricksDeck is provided without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement;
• —we are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities;
• —our total aggregate liability for any claim is capped at the fees you paid in the 12 months preceding the claim;
• —we are not responsible for losses resulting from third-party services or events beyond our control.

10Termination

Either party may end this agreement as follows:

• —By you — cancel your subscription at any time from your account settings; cancellation takes effect at the end of your current billing period.
• —By us — we may suspend or terminate your account immediately if you breach these Terms, fail to pay fees, or engage in activity that harms the platform or other users.
• —Effect — on termination your access to the platform ceases. You may export Your Content for up to 60 days, after which we delete it unless retention is required by law.

11Governing law and disputes

These Terms are governed by and construed in accordance with the laws of India, and any dispute falls to the exclusive jurisdiction of the courts in Gurugram, Haryana. Before initiating legal proceedings, the parties agree to attempt resolution through good-faith negotiation for 30 days; if the dispute remains unresolved, either party may refer it to arbitration under the Arbitration and Conciliation Act, 1996, with the seat of arbitration in Gurugram.

12Changes to these terms

We may modify these Terms from time to time. When we make material changes, we will notify you by email or in-app notification at least 30 days before they take effect. Your continued use of BricksDeck after the effective date constitutes acceptance of the updated Terms.
